1. ACCEPTANCE OF TERMS

These Terms of Service (“Terms” or “ToS”) govern your access to and use of the delivery services provided by Green Dash Delivery (“Green Dash Delivery,” “we,” “us,” or “our”), a California licensed cannabis delivery service based in Santa Ysabel, California. By accessing or using our website, greendashdelivery.com, or mobile applications (collectively referred to as the “Service” or “Solution”), you agree to comply with and be bound by these Terms.

If you do not agree to these Terms, you must immediately discontinue use of the Service.

2. ABOUT GREEN DASH DELIVERY

Green Dash Delivery is a licensed cannabis delivery service operating under the laws of California. Our eCommerce website and mobile application (collectively, the “Solution”) allow users to place orders for cannabis products and schedule deliveries from our facility. Please note that Green Dash Delivery is not a dispensary, medical provider, or producer of cannabis products.

3. ELIGIBILITY

To use the Service, you must:

• Be at least 21 years old or meet the minimum age requirement in your jurisdiction (whichever is higher);

• Be a resident of California;

• Have a valid email address and phone number;

• Have the legal right to purchase and receive cannabis products under applicable state and local laws.

By using the Service, you affirm that you meet these eligibility requirements and agree to comply with all applicable laws.

4. ACCOUNT CREATION AND SECURITY

To access the delivery services, you must create an account through our website or mobile app. You agree to:

• Provide accurate, current, and complete information during the account registration process;

• Maintain the confidentiality of your account credentials and accept responsibility for all activities that occur under your account;

• Notify us immediately of any unauthorized use of your account.

5. USE OF THE SERVICE

You agree to use the Service only for lawful purposes and in compliance with all applicable local, state, and federal laws. In particular, you agree to:

• Use the Solution for personal, non-commercial purposes only;

• Refrain from using the Service to engage in any fraudulent, illegal, or harmful activities.

6. ORDERING AND DELIVERY

• Placing Orders: Once your account is created, you may place orders through the website or mobile app for cannabis products offered by Green Dash Delivery. Orders are subject to acceptance based on product availability and local delivery regulations.

• Delivery: Green Dash Delivery will arrange delivery of products from our facility in compliance with California state laws. You must be present at the delivery address and provide valid government-issued identification upon delivery to verify your age and identity.

• Payment: Payments for products and delivery fees will be processed through the Service, and you agree to pay the total amount displayed at checkout, including applicable taxes and delivery fees.

7. CANCELLATIONS AND RETURNS

• Order Cancellations: You may cancel an order before it is confirmed. Once an order is confirmed and in transit, cancellations may not be possible. Please contact us immediately if you need to cancel an order.

• Returns: Due to the nature of the products, returns are generally not accepted. If you receive defective or damaged products, please contact customer support within 48 hours for assistance.

8. PRIVACY AND DATA COLLECTION

Your privacy is important to us. By using the Service, you agree to our Privacy Policy, which outlines how we collect, use, and protect your personal information. You acknowledge and consent to the collection of data for the purpose of providing the delivery service, verifying your identity, and improving the Service.

9. PROHIBITED CONDUCT

You agree not to:

• Violate any applicable laws or regulations, including those related to cannabis use, delivery, or consumption;

• Engage in any disruptive behavior or attempt to access the Solution or our systems in an unauthorized manner;

• Use the Service to solicit or harass others.

10. LIMITATION OF LIABILITY

Green Dash Delivery is not responsible for any indirect, incidental, special, or consequential damages arising from the use of the Service. Our liability is limited to the amount paid by you for the specific products or services giving rise to the claim, to the extent permitted by law.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Green Dash Delivery, its affiliates, employees, contractors, and agents from any claims, liabilities, damages, and expenses arising out of your use of the Service, including any violation of these Terms.

12. CHANGES TO THE TERMS

Green Dash Delivery reserves the right to modify or update these Terms at any time. We will post any changes on this page and will update the “Last Revised” date at the top of the Terms. Continued use of the Service after such changes constitutes your acceptance of the updated Terms.

13. DISPUTE RESOLUTION AND ARBITRATION

Any dispute or claim arising out of or related to these Terms or your use of the Service shall be resolved through binding arbitration, rather than in court. By using the Service, you agree to waive your right to a trial by jury and agree that all disputes will be resolved in accordance with the rules of the American Arbitration Association (AAA).

14. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in San Diego County, California.
